Commission & Project Policy

By submission of a commission application, you (the Client) agree to my (the Artist, BLeesArt) terms listed underneath. Please read them in full

By accessing or using this Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

 

1. Definitions

A) Client Materials refers to all materials, information, photography, writing and other creative content provided by Client for use in the preparation of and/or incorporation in Commissions.

B) Copyrights refers to the property rights in original works of authorship.

C) Commissions refers to any services and or product I provide to you through commissioned agreements including all creative content developed for you by me.

D) Services refers to any services and the work product to be provided to Client by Designer as described and otherwise further defined in the Proposal.

E) Design Materials refers to all design materials and tools made by and/or used by BLeesArt in performing Services, including without limitation art supplies, graphics, application tools, and any other software.

F) Concept Creation refers to all artwork including, but not limited to, concept development, thumbnails, vision boards, estimations or sketches.

G) Project Use refers to the purpose of intended use of the work produced as described in the Scope of Work.

H) Scope Of Work refers to the proposal or summary of work; a document which will outline the details of the commission, and the fees that will be paid, and contact information of all involved parties.

 

2. Commission/Project Fees & Expenses.

A) Commission/Project Fees: Fees are to be paid in full, upfront unless otherwise agreed. This information will be provided in the Scope of Work.

B) Commission/Project Expenses: Client shall pay BLeesArt any and all out-of-pocket expenses applicable to commissioned work including but not limited to cost of supplies, communication costs, postage/shipping, presentation materials, photocopies, computer expenses, tools, subscriptions & services, travel expenses, parking fees, tolls etc.

C) Commission/Project Invoices: All invoices are payable in full, within 48 hours of receipt. Work will not begin until the invoice has been paid in full.

D) Cancellation Fee: If you wish to cancel a commission after the scope of work has been signed, you will be provided with an invoice including a cancellation fee, and any material and or planning expenses that apply to your commission/project.

 

3.  Commission/Project Changes.

A) General Changes: I allow one instance of major change to initial design. This change is only allowed in the beginning Concept Creation stage of the project. Any changes after this stage results in an alteration fee. Changes after the Scope of Work as been signed, are not accepted.

B) Substantial Changes: If you request  Changes that are considered to be excessive in light of the scope of the Services, I shall be entitled to submit a new and separate Proposal to Client for written approval. Work shall not begin on the revised services until a fully signed revised Proposal and, if required, any additional retainer fees are paid for.

C) Time Frame Changes: I reserve the right to begin, pause or cancel any and all commissions/projects. You agree to review works in progress and provide commentary, all change requests, approve the work and so within 48 hours of proposal receipt. Be aware that I will notify you when I begin and stop working on your commission, including any delay notification.

 

4. Commission/Project Accreditation & Promotions of Creative Content Notice

A) Creative Content: I retain the right to use, reproduce, publish and display any and all artwork that I create, finished or unfinished,  any commission related work or materials, including that of which may be provided by the client (Client Materials), for live-streaming, social media, and advertising content. I also retain the right to use any and all work I produce in portfolios, websites, videos, and digital & paper published content, in galleries, articles, interviews, trade shows and other media. Also note that unless otherwise agreed upon, your commissioned project will likely be worked on during public live-streams, and all stages of work may be shared on public social media platforms. I also retain the right to utilize the artwork to sell prints, altered or unaltered, and to use as advertisement of my work.

 

5. Rights to Final Art

For non-commercial commissions, I grant you (the Client) the right to display the final commission / project as long as no profit is made from the work, and proper credit is given to me. Credit includes linking to my social media pages, and my website (www.artbyowl.com). You may NOT display, distribute, reproduce, modify, change, or adapt, my work for profit and/or without appropriate credit.

 

6. Cancellations

Once the scope of work has been signed, there are no cancellations of commissions/projects unless I determine that I am unable finish the work. If I determine that I am unable to finish the work agreed in the outlined in the Scope of Work, some of the amount paid by the client may be refunded. If any amount is to be refunded, it will directly reflect the amount of work that has already been done, and any costs to the Artist that have already occurred. The client may also be subject to a cancellation fee.
